Terms of Use

These Terms of Use ("Terms") are a legal agreement between you and ArcStax ("ArcStax", "we", "us", or "our"), the publisher of the WildMorph mobile application ("WildMorph" or the "App").

By downloading, accessing, or using WildMorph, you agree to these Terms. If you do not agree, please do not use the App.

WildMorph lets you select or take a photo and uses third-party generative artificial intelligence to transform it into a stylized animal image (a "morph"). To create a morph, the photo you choose is sent to fal.ai (FAL AI, Inc.), our third-party AI image-processing provider, which uses it only to generate your morph and return it to the App. How your photo is handled is described in our Privacy Policy.

WildMorph uses automated, probabilistic AI models. Results are generated automatically and are inherently unpredictable. They may be inaccurate, distorted, unflattering, unexpected, or otherwise not what you intended, and may occasionally produce output that you or others find surprising or objectionable.

All morphs are provided "as is" and "as available", without warranty of any kind as to their accuracy, quality, appropriateness, or fitness for any purpose. ArcStax does not review every generated image before it is returned to you and does not endorse, and is not responsible for, the specific output that the AI produces. You are solely responsible for the photos you upload and for how you use, save, publish, or share the images you generate.

Morphs are fictional, AI-generated images. Because the AI draws on patterns learned during training, an output may occasionally resemble a real, identifiable person — including a public figure or celebrity — even though no such likeness was intended. Any such resemblance is coincidental and unintended, and does not imply any association with, or endorsement by, that person. You are solely responsible for ensuring that any morph you choose to publish, distribute, or use commercially does not infringe the privacy, publicity, intellectual-property, or other rights of any real person.

You agree that you will not use WildMorph to upload, create, or share any content that:

• is a photo of a person other than yourself, unless that person is an adult who has agreed to your using their photo in WildMorph, or is a child for whom you are the parent or legal guardian;
• is a photo of a minor uploaded by anyone other than that minor’s parent or legal guardian, or any photo of a minor used in a harmful, sexualized, or exploitative way;
• is unlawful, infringing, defamatory, harassing, hateful, or that promotes violence or discrimination against any individual or group;
• is sexually explicit, pornographic, or depicts nudity;
• impersonates another person or misrepresents the source of an image;
• violates the rights (including privacy, publicity, or intellectual-property rights) of any third party; or
• publishes, distributes, or commercially uses a morph that resembles a real, identifiable person (including a public figure or celebrity) in a way that would infringe that person’s privacy, publicity, or other rights, or that falsely suggests their association or endorsement.

You are responsible for ensuring you have the right to use any photo you upload. We may, at our discretion, remove content, refuse service, or restrict use that we believe violates these Terms or applicable law.

If WildMorph produces an image you believe is objectionable, or if you encounter misuse of the App, you can report it to us at wildmorph@arcstax.com, or by tapping "Report this image" on the result screen in the App. We aim to review reports promptly and will take appropriate action, which may include adjusting our content filters or restricting the offending use.

WildMorph uses consumable "credits" to create morphs. Credits and content packs are purchased through the Apple App Store and are subject to Apple's payment terms. Except where required by applicable law, purchases are final and non-refundable. Refund requests for App Store purchases are handled by Apple in accordance with Apple's policies.

As between you and ArcStax, you retain ownership of the photos you upload. You grant ArcStax a limited, temporary license to process your photo solely to provide the morph to you, as described in our Privacy Policy. The WildMorph name, app design, and software are owned by ArcStax and protected by intellectual-property laws; nothing in these Terms transfers those rights to you.

To the fullest extent permitted by law, WildMorph and all content generated through it are provided "as is" and "as available", without warranties of any kind, whether express or implied, including any implied warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy. We do not warrant that the App will be uninterrupted, error-free, or that any morph will meet your expectations.

To the fullest extent permitted by law, ArcStax and its officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of data, reputation, or goodwill, arising out of or relating to your use of WildMorph or any AI-generated content. To the extent liability cannot be excluded, our total aggregate liability is limited to the greater of the amount you paid us in the twelve (12) months before the claim or USD $50.

Some jurisdictions do not allow certain limitations of liability or exclusions of implied warranties, so some of the above may not apply to you. Nothing in these Terms limits rights that cannot be limited under applicable consumer law.

You agree to indemnify and hold harmless ArcStax from any claims, damages, or expenses (including reasonable legal fees) arising out of content you upload or generate, your use of the App, or your violation of these Terms or the rights of any third party.

WildMorph relies on third-party services, including fal.ai for image generation. Your use of those services through the App is also subject to their respective terms and privacy policies. We are not responsible for the practices of third-party services beyond what is described in our Privacy Policy.

These Terms are between you and ArcStax only, not with Apple. Apple is not responsible for WildMorph or its content. To the extent applicable:

• Apple has no obligation to provide maintenance or support for WildMorph;
• in the event of any failure of the App to conform to any applicable warranty, you may notify Apple and Apple will refund the purchase price (if any) for the App; to the maximum extent permitted by law, Apple has no other warranty obligation with respect to the App;
• Apple is not responsible for addressing any claims relating to the App, including product-liability, legal/regulatory, or consumer-protection claims;
• Apple is not responsible for investigating, defending, settling, or discharging any third-party claim that the App infringes intellectual-property rights; and
• Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.

You represent that you are not located in a country subject to a U.S. Government embargo and are not on any U.S. Government restricted-parties list.

We may update these Terms from time to time. The revised version will be posted here with an updated date. Your continued use of WildMorph after changes take effect constitutes acceptance of the updated Terms.

These Terms are governed by the laws of the State of California, United States, without regard to its conflict-of-laws rules, except where mandatory local consumer-protection law applies.
